In consideration of being given the opportunity to participate in the event activities scheduled on November 9th - 10th, 2012 at the Deauville Beach Resort, Miami Beach, FL. I hereby release the Panamerican Internationals, 4 Seasons Tour, Florida NASKA and the North American Sport Karate Association (NASKA), The City of Miami Beach and their officers, directors, promoters, employees, volunteers, agents, sponsors, and assigns from any and all liability for damage to or loss of personal property, sickness or injury from whatever source, legal entanglements, or death which might occur while participating in any Panamerican Internationals, 4 Seasons Tour activities. I specifically release Panamerican Internationals, 4 Seasons Tour, Florida NASKA and the North American Sport Karate Association (NASKA), or the City of Miami Beach from any liability or responsibility for the condition of the premises, which I had the opportunity to inspect. I understand the nature of the Martial Arts Tournament activity and present that I, as a participant, or any minor child participant, am/is qualified to participate, in good health, and proper physical condition to participate. I am aware of the risks of participation, which include, but are not limited, to the actions of any other participants and spectators and the chance of serious bodily injury, including permanent disability, paralysis, and death, from engaging in the Martial Arts Tournament event activities. I understand that participation in the Martial Arts Tournament event activities is strictly voluntary and I freely choose to participate or for my minor child to participate.
I further grant the Released Parties the right to photograph and/or videotape me and/or my child or ward and further to display, use and/or otherwise exploit my and/or my child’s or ward’s name, face, likeness, voice, and appearance forever and throughout the world, in all media, whether now known or hereafter devised, throughout the universe in perpetuity (including, without limitation, in online web casts, television, motion pictures, films, newspapers, and magazines) and in all forms including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes, including, without limitation, publication of event results and standings, without compensation, reservation or limitation. I further authorize distribution by the Released Parties of my contact information, including my e-mail address, to third parties for promotional purposes, or for any other purpose whatsoever, without compensation, reservation or limitation. The Released Parties are, however, under no obligation to exercise any rights granted herein.
This Waiver and Permission Form shall be governed by the codified and common laws of the State of Florida without regard to conflicts of laws principles. Any legal proceeding of any nature brought by either party against the other to enforce any right or obligation under this Agreement, or arising out of any matter pertaining to this Agreement, shall be submitted for trial, without jury, before the Superior Court in and for Broward or Miami/Dade Counties, Florida or, if the Superior Court does not have jurisdiction, then before any other court sitting in Broward or Miami/Dade Counties, Florida, having subject matter jurisdiction. The parties consent and submit to the exclusive jurisdiction of any such court and agree to accept service of process outside the State of Florida in any matter to be submitted to any such court pursuant hereto, and EXPRESSLY WAIVE ALL RIGHTS TO TRIAL BY JURY REGARDING SUCH MATTER. I certify I am 18 years of age or older and, if I am executing this Waiver and Permission Form on behalf of my minor child or ward, the information set forth above pertaining to my child or ward is true and complete.
